Final Sale and No-Return Policy

Effective date: January 1, 2011

Thank you for purchasing from MYMOBILITY LTD. Please review this policy carefully before placing an order or purchasing a service.

1. All Sales Are Final

Except where required by applicable law or as specifically provided below, all purchases made through our website are final.

We do not accept returns, exchanges, cancellations, or refund requests for reasons including:

  • Change of mind

  • Ordering the wrong product, size, quantity, or service

  • Personal preferences or dissatisfaction unrelated to a defect

  • Failure to use a product or service

  • Finding the same or a similar offering at a lower price

  • Digital products, downloadable materials, gift cards, customized products, appointments, subscriptions, or services that have already been accessed, delivered, started, or completed

Customers are responsible for reviewing product descriptions, service details, prices, measurements, compatibility requirements, and other relevant information before completing a purchase.

2. Defective, Damaged, or Incorrect Items

We will review requests involving an item that:

  • Arrived damaged;

  • Has a manufacturing defect;

  • Is materially different from what was ordered; or

  • Was sent incorrectly by us.

Please contact us promptly after discovering the issue at info@mymobility.ca.

Your request must include:

  • Your full name;

  • Your order number; and

  • A description of the problem; and

  • Clear photographs or videos showing the defect, damage, or incorrect item.

We may request additional information or require the item to be returned for inspection before approving a remedy.

Normal wear and tear, accidental damage, misuse, improper installation, unauthorized modification, failure to follow instructions, and damage caused after delivery are not considered defects.

3. Available Remedies

When we confirm that an item is defective, damaged upon delivery, or incorrect, we may provide one of the following remedies, subject to applicable law:

  • Repair of the item;

  • Replacement with the same or a comparable item;

  • Store credit; or

  • A full or partial refund.

The appropriate remedy will be determined based on the circumstances, product availability, the nature of the defect, and applicable consumer-protection requirements.

Do not return an item without first receiving written return authorization from us. Unauthorized returns may be refused.

When we approve the return of a verified defective, damaged, or incorrect item, we will provide return instructions and advise whether reasonable return-shipping costs will be covered.

4. Services and Digital Offerings

Payments for services, appointments, consultations, memberships, subscriptions, digital products, and downloadable content are final once the offering has been accessed, delivered, scheduled, started, or completed.

If a service or digital offering was not supplied as described because of an error by us, please contact info@mymobility.ca. We will review the circumstances and provide an appropriate remedy where required.

This policy does not eliminate any cancellation or refund right that cannot legally be excluded.

5. Shipping Issues

We are not responsible for:

  • Incorrect or incomplete delivery information supplied by the customer;

  • Delivery delays outside our reasonable control;

  • Packages marked as delivered by the carrier;

  • Unclaimed or refused packages; or

  • Damage caused after confirmed delivery.

Customers should contact the shipping carrier regarding lost or missing packages. We will provide reasonable assistance with a carrier investigation when available.

6. Chargebacks

Customers must contact us and allow a reasonable opportunity to investigate and resolve a concern before initiating a payment dispute or chargeback.

Submitting a chargeback does not expand the customer’s rights under this policy or applicable law. We reserve the right to provide the payment processor with relevant order, delivery, communication, and account records when responding to a dispute.

7. Consumer Rights

Nothing in this policy excludes, restricts, or limits any warranty, cancellation right, remedy, or consumer-protection right that cannot legally be excluded under the laws of Canada or the customer’s province or territory.

Where this policy conflicts with mandatory applicable law, the applicable law will prevail.
